TERMS OF PURCHASE

Important Notice

This is not a contract. Actual terms and conditions are detailed in the contract issued to OPSWA. It contains important details concerning exclusions, conditions and limitation.

Member Eligibility

You must be working on a full time or part time permanent basis, at least 10 months during the year, and have provincial health insurance coverage.

You must work at least 20 hours a week and be actively employed at the time of the member's effective date of the contract (Hours may be accumulated with many different employers).

You must be a resident of Ontario.

You are a member in good standing with OPSWA.

Member Information

You agree that all information you provide to Canadian Benefit Providers in any connection with this Site is true and complete in all ways and may be relied upon to provide you and your dependants with accident, health and dental coverage. You also agree that any information provided about your dependant(s) is provided with their consent.

Effective Date of Coverage

Coverage will commence the first day of the month following payment of the monthly premium.

Termination of Coverage

Coverage will terminate the earliest of age 65 or 3 months after no longer being a member in good standing with OPSWA or the first of the next month that premiums are not paid.

If your coverage terminates for any reason you will not be eligible to re-enroll for a period of 2 years.

LEGAL NOTICES AND DISCLAIMERS OF LIABILITY

Secure Areas of Website

The ProHealth Website (Secure Areas) requires a password to gain access and use the Website functions. If you are permitted to access and use the Secure Areas it is your responsibility to keep your password private so that it cannot be used by other. Canadian Benefit Providers will not be liable for any damages, losses or expenses suffered by you or any third party as a result of any unauthorized person gaining access to any of the Secure Areas through use of your password, and you agree that you will indemnify Canadian Benefit Providers for any damages, losses or expenses that it may suffer, including any claims made against it by third parties, as a result of such access or use by an unauthorized person.

Limitation of Liability

In No event will Canadian Benefit Providers be liable for any damages, including without limitation direct or indirect, special, incidental, or consequential or punitive damages, losses or expenses, whether or not Canadian Benefit Providers, or representatives thereof, are advised of the possibility of such damages, losses or expenses, arising in connection with your or any third parties use of, or inability to use this or the ProHealth Website.

Information and Availability

Information provided by Canadian Benefit Providers on its Website is believed to be accurate and reliable, but we cannot guarantee that such information is accurate or complete or current at all times. While we endeavor to keep the information current, such information is subject to change at any time without notice.

Canadian Benefit Providers makes reasonable commercial efforts to make the Website available, however, it is not responsible for any service interruptions. Canadian Benefit Providers will not be liable for any loss resulting from a cause over which it does not have direct control, including, but not limited to, failure of electronic or mechanical equipment or communication lines, telephone or other interconnect problems, computer viruses, unauthorized access, theft, operator errors, strikes or government restrictions.

Privacy Policy

The very nature of our business at Canadian Benefit Providers Inc. (CBP) requires the collection and use of personal information. At CBP we are dedicated to protecting this information. This policy outlines how we collect and manage personal information.

How do we obtain consent?

By purchasing CBP’s products and services or applying for benefits, you are providing your consent to our collection, use and disclosure of your personal information as set out in this Privacy Policy.

When collecting information from an individual CBP will obtain consent for the use or disclosure of that personal information. In many cases, CBP relies on the broker’s advice to obtain a Plan Member’s consent to collect information. Consent may also be obtained through authorized partners or third-party contractors when personal information is collected for claims purposes.

In certain limited circumstances, personal information can be collected, used, or disclosed without the knowledge and consent of the individual. In some legal, medical, or security contexts, seeking the consent of the individual might defeat the purpose of collecting the information. Likewise, if the individual is a minor or seriously ill seeking consent may be inappropriate or even impossible.

An individual may decline to consent, or revoke consent, to the collection and use of personal information for insurance purposes. In that case, some benefits and the assessment of claims may be limited.

What is personal information and what information do we collect?

Personal information is any information that identifies an individual. At CBP we collect the following information about Plan Members: Name, mailing address, contact information, date of birth, gender, banking information and health/medical information. In the case of Members with registered Dependants, we collect: name, mailing address, contact information, date of birth, gender and health/medical information.

How do we use this information?

We collect personal information from our Plan Members for the purposes of administering their Benefit Plan as well as adjudicating and paying their claims.

We may sometimes share your personal information with other companies, including: partners, suppliers and third-party contractors. For example, we may pass on your name and address to a courier company to complete a delivery. If it is a necessary part of a transaction, we may disclose your medical information to another company. For example, a Short Term Disability plan may be underwritten by another insurance company. To assess and compensate a related claim would require substantiating medical information to be passed onto the insurance carrier.

CBP may also collect and use personal information for marketing purposes, such as identifying and communicating with individuals who are most likely to find CBP products and services of interest. You may opt not to have CBP use this information for marketing purposes.

CBP does not sell customer lists or other personal information.

Ensuring Accuracy

Personal information will be as accurate, complete and up-to-date as is necessary. However, we rely on individuals to disclose all material information and to inform us of any changes required. A request to correct information in our possession may be made by contacting the Privacy Officer at the address set out below.

Revoking Consent or Challenging Compliance

An individual may decline to consent, or revoke consent, to the collection and use of personal information. In that case, some benefits and the assessment of claims may be limited.

An individual may also address concerns regarding compliance with this policy. To revoke consent or make a complaint contact CBP’s Privacy Officer, whose contact information is listed below.

Canadian Benefit Providers Inc. will investigate and respond to all complaints. If a complaint is found to be justified, CBP will take appropriate measures, including, if necessary, amending its policies and procedures.

Retention and Access to Your Personal Information

We retain personal information for the purposes described above but only for so long as is necessary to fulfill the purpose to underwrite, adjudicate or administer insurance products and services and to meet our legal and contractual obligations. Personal information is stored at one of our offices in Canada. Access to your personal information is limited to our employees, agents and service providers who need access in order to perform their job or provide services to us. Given the nature of insurance and our on-going exposure to potential claims, where necessary, and when legally required, some of the information we collect for insurance purposes is kept indefinitely.

With proof of entitlement, a request to access information in our possession may be made by contacting the Privacy Officer at the address set out below in the section called “Contacting the Privacy Officer”. The right to access information is not absolute therefore, CBP may decline access to information that we have under our control subject to any legal restrictions or rights of refusal by CBP, such as;

• the information subject to a legal privilege;
• the information would reveal personal information about a third party;
• the information could compromise the investigation of a claim;
• the information is confidential commercial information; and
• personal health information that has not been provided to us directly by the individual requesting access.

We may charge a reasonable fee in advance for copying and sending information you have requested and to which you have a right of access.

Safeguarding Your Information

We apply appropriate safeguards to our computer networks and physical files and we restrict access to personal information to those CBP employees, authorized administrators, reinsurers, consultants or insurance representatives who need to know that information in order to underwrite, adjudicate or administer insurance products and services.
